The mediation team organized a facilitated discussion to understand how the parties really understood the term. When session participants wrote down anonymous definitions of \u201cbest available science,\u201d it became clear that the seemingly harmless phrase brought up different and powerful associations for different people. Here are some of the responses that were offered: 1. \u201cBest Available Science = manipulation to meet a desired outcome.\u201d<\/p>\n

2. \u201cWhy does it matter. There\u2019s no political will to follow best available science.\u201d 3. \u201cMV3 is simply data. It doesn\u2019t have a will or an agenda. The facts are facts. How can you argue with fact??????\u201d 4. \u201cIt has to be agreed to by the co-managers.\u201d Having examined the various reactions, Moira asked for more clarification around number 4. \u201cFor the person who offered this, or anyone who feels similarly: Do you mean that you feel the tribal co-managers have to agree with the science if it is ever to be used?\u201d<\/p>\n

On one hand, this seemed like another goofy question. How could anyone agree or disagree with science? Wasn\u2019t the point of science that it was objective and for everyone? But discussing the question prompted the sharing of several stories about how communication of research findings has failed in the past. Specifically, the tribes found prior briefings overly technical and lacking useful insights. They also felt that the reports from the state contained bias, featuring additional conclusions that were not supported by the data.<\/p>\n

A tribal rep spoke up: \u201cThis comment with all the question marks\u2026the one about arguing with facts. What do you have to say about the fact that personal beliefs and information that\u2019s not supported by the MV3 report winds up in your damn policies? How is that \u2018best available science\u2019?\u201d<\/p>\n

Not surprisingly, that comment led to a lot of back-and-forth, until Moira asked another innocent-seeming question: \u201cI wonder if the state could talk a little bit about the decision-making and communications that accompany the data when it is given over to the tribes?\u201d As the state representatives went about explaining their process for turning raw data into reports and policies, one of them voiced a realization: \u201cWe are conflating science with data. MV3 is just data. Science is a process of inquiry; of synthesizing and analyzing data\u2014that\u2019s science.<\/p>\n

That process could improve, and it could be more clear, inclusive, and transparent.\u201d Another state rep added: \u201cThe data will never be perfect, and we\u2019ll always be revisiting what we know, but we need to act on something in the meantime.\u201d<\/p>\n
